Compensation Scheme for women victim/survivors of sexual assault and other crimes 2018
- The lack of a uniform scheme for compensation meant many rape survivors failed to get compensation and this led to Apex Court’s intervention.
- In an order dt.Sept.05,2018, passed by bench comprising JJ MB Lokur, S. A.Nazir and Deepak Gupta, applicable nationally, Supreme Court has ruled a rape survivor will get a mandatory minimum compensation of Rs. 4 lakh and in case of gangrape, Rs.5 Lakh.
- Directed States to implement order from Oct.02,2018 in accordance with a scheme framed by the National Legal Service Authority in consultation with the Centre.
- The Monetary relief granted under the scheme is not linked with trial proceedings and the survivor can approach the state or district legal services authority for compensation immediately after registration of FIR.
- The scheme empowers legal services authority to take Suo moto cognizance of cases of sexual assault and acid attack to grant interim relief to survivors.
- Minor survivors of rape or sexual assault will get compensation on par with women victims.
- NALSA scheme would be made applicable to minor victims from Oct. 02, 2018 until the Centre frames compensation guidelines under the POCSO.
